Who is responsible for the processing of my data?
UFA SHOW & FACTUAL GmbH, Siegburger Straße 215, 50679 Cologne (“UFA”) is the controller within the meaning of data protection law.
The data protection officer of UFA is Bertelsmann SE & Co. KGaA (Group Data Protection). I can reach them via UFA at the above postal address or by e-mail to datenschutz.usf@ufa.de, in each case with the addition “To the data protection officer”.
What personal data is processed?
UFA processes the personal data received from me in the context of my inquiry, my application, the subsequent casting and/or the production. In addition, UFA may legitimately process personal data about me from third parties (e.g. agencies, insurance companies) or from publicly accessible sources (e.g. press, media, internet, social media).
UFA only processes special personal data (e.g. data on origin, health data) if this is necessary and legally permissible.
My personal data is collectively referred to as “data”.
For what purposes and on what basis will my data be processed?
My data will only be processed for the purposes for which I have provided this data or for which it was collected. These purposes include the processing of my request, the execution of the casting, in particular the selection process, the initiation and execution of the contract (including staff lists, building security; if necessary, processing of winnings), the creation, exploitation, advertising and marketing of the production and reporting on the production as well as my person and my participation in the production, furthermore for the fulfillment of legal obligations, the proof of the chain of rights, e.g. in the case of intervention by third parties, and the fulfillment of any copyright claims. The processing is also carried out for the purpose of presenting UFA’s business activities to third parties. The legal basis for this processing is Art. 6 (1) b, c and f of the General Data Protection Regulation (“GDPR”). Insofar as the processing is based on a legitimate interest, this serves in particular to secure the investment of the processors in the production and thus outweighs my rights to my data. Furthermore, on the basis of relevant special laws (e.g. Art Copyright Act)
If it concerns special personal data (Art. 9 GDPR), the processing is carried out on the basis of Art. 9 (2) a and e in conjunction with Art. 6 (1) a, c and f GDPR.
If I have consented to the processing of my data, the processing is carried out to the extent of the consent given (Art. 6 (1) a GDPR). This applies in particular if I have consented to the storage and subsequent further processing of my data in the casting or ticketing database for the selection and approach as a potential participant or viewer for other productions or the sending of newsletters or other promotional contact (e.g. offers) for other productions.
Who receives my data?
For the above-mentioned purposes, my data will be passed on to the commissioning broadcaster/streamer and companies commissioned by them with marketing and exploitation (Art. 6 (1) b and f GDPR). For any prize processing, my data will be passed on to financial service providers or, in the case of non-cash prizes, to manufacturers/sellers/shippers (Art. 6 (1) b and f GDPR). Furthermore, my data may be passed on to the press and other media for reporting purposes (Art. 6 (1) b and f GDPR).
If I contact the UFA via WhatsApp, the terms of use of WhatsApp Ireland and WhatsApp Inc. apply, according to which WhatsApp receives access to my telephone number, contacts stored in my mobile device and my user behavior, for example. I can find more information on this at https://www.whatsapp.com/legal/#terms-of-service and https:// www.whatsapp.com/legal/#privacy-policy. UFA has no influence on the terms of use and data processing by WhatsApp. UFA is therefore not liable for any damage caused by the use of WhatsApp. I am free to use another contact option (e.g. e-mail) at any time.
In some cases, UFA uses external service providers (e.g. data centers, newsletter dispatch, casting agencies) to perform its tasks. These generally act as processors and process my above-mentioned personal data in accordance with UFA’s instructions. They are obliged to comply with the applicable data protection law, UFA’s instructions and confidentiality. For example, UFA currently uses M.K. Advision LTD in the area of “online casting” and M.K. Advision LTD in the area of “online casting” and Mailjet SAS in the area of “sending newsletters, advertising text messages and advertising emails”.
Will my data be transferred to a third country?
A transfer of my data to a country outside the EU/EEA (“third country”) will only take place if the transfer (i) is necessary for the assertion, exercise or defense of legal claims (e.g. legal reporting obligations, entry/exit requirements); (ii) is necessary for the performance of my contract, in my interest or for the implementation of pre-contractual measures at my request (e.g. foreign filming, hotel, flight or train bookings, image, video and sound recordings as part of the publication of the production) or (iii) is permitted on the basis of my consent.
How long will my data be stored?
Data is stored for as long as it is required for the stated purposes, unless statutory retention and protection periods (e.g. under the German Commercial Code, the German Fiscal Code, limitation periods for third-party claims) require longer storage. For example, in order to prove the necessary exploitation and broadcasting rights to the production, storage may also be necessary beyond the expiry of the statutory retention and protection periods (e.g. 70 years after the death of the author), unless the legitimate interest in proving the chain of rights no longer applies.
What rights do I have in relation to my data?
I have the right to information (Art. 15 GDPR) about the processing of my data at UFA, to correction of my data (Art. 16 GDPR), deletion (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), the right to object to data processing for reasons arising from my particular situation, insofar as this is based on a legitimate interest (Art. 6 para. 1 lit. f GDPR) (Art. 21 GDPR) or to receive a copy of the data concerning me (Art. 20 GDPR). The right to withdraw consent under data protection law does not apply if the processing is based on a contract or another legal basis. If I have given my consent, I can revoke it at any time with effect for the future (Art. 7 GDPR). The lawfulness of the processing of my data until the revocation remains unaffected. Finally, I am entitled to lodge a complaint with a supervisory authority. The above rights exist in each case to the extent of the respective legal framework.
Is there an obligation to provide the data?
Information marked with * on the application form, for example, is mandatory. Without this information, my request or application for the casting, and possibly the subsequent production, cannot be processed or may only be processed to a limited extent.
