UFA SHOW & FACTUAL GmbH (hereinafter referred to as “UFA”) maintains a talent pool. This is a database in which people who are interested in participating in TV and streaming productions can enter their profile (hereinafter “talent pool”). Registration is only possible at the invitation of UFA.

The following General Terms and Conditions of Use (“GTC” or “User Agreement”) apply exclusively to the use of the Talent Pool.

a) If you have received an invitation from UFA, you can register in the talent pool. The prerequisite is that you are at least 18 years old and interested in participating in a production in front of the camera, e.g. as a protagonist, extra, candidate or other participant.

b) After entering your data in the registration form and submitting it, you will receive a registration e-mail from UFA. If you click on the confirmation link in the registration e-mail, your registration is complete. You can now view, complete and edit your profile at any time. See also section 2.

If you do not confirm the link, your data will be stored in the input mask for up to six months. Until deletion, UFA will remind you by e-mail to complete the profile creation.

c) If you (e.g. as an agent) create a profile for a third party in the talent pool, you guarantee that you are authorized to make the entry. In the case of an undisputed, genuine placement service, any remuneration claims will be regulated in a separate contract. The invitation to register, the registration and profile creation do not give rise to any claim for remuneration on your part; in particular, no brokerage contract is concluded between UFA and you.

d) Your details must be truthful. You may not register more than once in the database. Please always keep your data up to date.

e) You must ensure that the access data for the profile sent to you with the registration e-mail is not accessible to third parties. Inform UFA immediately if third parties have nevertheless gained access.

f) Please note that registering and creating a profile does not entitle you to participate in a casting or a production. If UFA invites you to a casting, separate casting regulations apply. You will be informed of these in good time.

a) If fields are marked with *, we require this information for registration or profile creation. This includes your name, for example. Otherwise, you can decide for yourself which personal data you would like to enter in your user profile. The data may include physical characteristics (e.g. height, weight, hair color, hairstyle), but also information about your personal interests (e.g. hobbies), your skills (e.g. driving license, sporting ability) or your relationship status. You are not obliged to provide this information in order to be included in the talent pool.

b) You have the option of uploading your own content (e.g. photos, videos, songs) to your profile. You can replace this with other content at any time and – provided it is not mandatory – delete it.

c) If you upload content to your profile, you grant UFA the non-exclusive right, unrestricted in terms of time, place and content, to use this content as part of the casting process and for the acquisition of production orders. This means in particular that UFA may archive and edit the content for the aforementioned purposes, combine it with other content, information and/or your name and pass it on to third parties, e.g. broadcasters or streamers. UFA is not obliged to make use of this right of use.

d) By uploading the content, you guarantee that you are authorized to upload the content to your profile and to grant UFA the corresponding rights of use. You further guarantee that the content does not violate any third-party rights (in particular trademark, copyright or personal rights) and does not contain any illegal, in particular racist, pornographic, youth-endangering or offensive content.

The information on data protection has been made available to you. It is not part of these terms of use.

a) This contract of use runs for an indefinite period. If you wish to terminate the contract, you can inform UFA of this at any time by sending an e-mail to talentpool@ufa.de. In this case, your profile will be deleted as far as possible. Alternatively, UFA will send you a link with which you can delete your profile in the talent pool.

b) UFA can also terminate the user contract at any time and delete your profile. UFA will do this in particular if you or files uploaded by you violate these Terms of Use or statutory provisions.

a) If UFA suspects misuse of your user account, UFA is entitled to block the user account immediately. UFA can only unblock the user account again if you can prove your identity.

b) You are strictly prohibited from reading out or manipulating data stored by other users in the talent pool or sabotaging the database in any other way. Should you violate this, UFA may assert claims for damages against you.

a) UFA shall be liable to you without limitation for injury to life, limb or health caused by UFA itself or a vicarious agent, in the event of the assumption of a guarantee and in cases of intent and gross negligence. In the event of a breach of material obligations, the fulfillment of which is essential for the proper performance of the agreement and on the observance of which you regularly rely and were entitled to rely (cardinal obligations), UFA shall also be liable in cases of simple negligence. In this case, UFA’s liability shall be limited to the damage foreseeable and typical for the contract at the time the contract was concluded. Any further liability on the part of UFA is excluded.

b) The talent pool is provided free of charge. UFA endeavors to enable you to use the talent pool at any time. However, UFA does not assume any warranty for this.

a) UFA is entitled to amend these Terms of Use with your consent. In this case, UFA will inform you of the new terms of use in advance. If you continue to use your profile thereafter, you thereby declare your consent to the amended terms of use.

b) UFA is also entitled to change, restrict or terminate the content and availability of the talent pool at any time.

a) The above provisions apply exclusively to the use of the talent pool. There are no other agreements to these terms and conditions. Even if you send us contractual conditions by other means, these shall not apply. Not even if UFA continues to allow you to use the talent pool in full knowledge of these contractual terms and conditions.

b) Should individual provisions of this agreement be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid or enforceable provision that comes closest to the economic purpose of the original provision. The same applies to loopholes in this agreement.

c) This agreement is subject to the law of the Federal Republic of Germany.
