Information obligations pursuant to Art. 13 GDPR in the context of castings and productions

The following information provides you with an overview of the processing of your personal data (hereinafter referred to as “data”) in the context of castings and productions as well as your data protection rights.

1. who is responsible for processing my data?

is responsible for the processing of your data mentioned below. When reference is made below to “we” or “us”, this always refers to the aforementioned company.

We process personal data in accordance with the provisions of the European General Data Protection Regulation (hereinafter referred to as “GDPR”) and the German Federal Data Protection Act (hereinafter referred to as “BDSG”).

2. what is my data processed for (purpose of processing) and on what legal basis is the processing based?

a) Processing of your data as part of the application and casting process
The data you provide as part of the casting process will be stored and evaluated by us in order to assess whether you are a suitable candidate or contributor (“contributor”) for the respective production. They can also be used to carry out a casting. The legal basis for this is the implementation of pre-contractual measures between us in accordance with Article 6 (1) b of the General Data Protection Regulation (hereinafter “GDPR”).

b) Processing of your data as part of the production
If you are involved in a production, we process your data to create the respective production. The legal basis for the processing of your data is the fulfillment of the contract concluded between us in accordance with Article 6 (1) b GDPR.

c) Processing of your data in the context of broadcasting/evaluation of the production
We process your data collected in the context of the production in accordance with section 2 b for the purpose of broadcasting, evaluating and marketing the production. The legal basis for this is our legitimate interest pursuant to Art. 6 (1) f GDPR in the comprehensive exploitation of the production. Investment in productions is only worthwhile if they can be comprehensively exploited commercially. This also includes comprehensive marketing in relation to the production. Our right to comprehensive exploitation outweighs your right to your personal data.

d) Processing of your data in the context of billing
If remuneration has been agreed for your participation in the production, your billing-related data will be processed by us for billing purposes. The legal basis for the processing is the fulfillment of the contract concluded between us in accordance with Art. 6 (1) b GDPR.

e) Processing of your data as part of the casting database
If you have given your consent, your name, address, telephone number, e-mail address, age, gender, appearance and/or relationship status, if relevant for the casting, will be included in our casting database. We use this data to check whether you could be a suitable participant for a future production. If this is the case, we will contact you by email, post, telephone, text message or WhatsApp. You can revoke your consent at any time with effect for the future by sending an email to webmaster@ufa.de or by post to the address given in section 1. Your data in the casting database will then be deleted from the casting database immediately.

3. is there an obligation for me to provide the data?

As part of our business relationship, you must provide the data that is necessary for the establishment and execution of a business relationship and the fulfillment of the associated pre-contractual or contractual obligations or that we are legally obliged to collect. Without this data, we will generally not be able to conclude or execute the contract with you. This is the data collected in accordance with sections 2.a, b, c and d.

4 Who receives my data?

As part of the processing of your data for production in accordance with section 2.b, your data may also be transmitted to the respective commissioning broadcaster. The legal basis for the transfer is Art. 6 (1) b GDPR.

As part of the processing of your data in the context of the broadcast and exploitation of the production, your data may be transmitted to the respective commissioning broadcaster, press and media, if applicable. The transfer takes place on the basis of a balancing of interests in accordance with Art. 6 (1) f GDPR.

We also use service providers (processors, e.g. database operators, newsletter and SMS service providers) in accordance with instructions, including for technical support and, for example, sending e-mails and SMS. All processors will only have access to your data to the extent and for the period of time required to provide the services. If these service providers process your data outside the European Union, this may result in your data being transferred to a country that does not guarantee the same data protection standard as the European Union. In this case, we will ensure that the service providers guarantee an equivalent level of data protection by contract or other means. You can request a copy of these guarantees using the contact details provided in section 1.

5. how long will my data be stored?

The data collected in the context of section 2.a will be stored in our casting database with regard to your casting. If you have not given us your consent to use your data beyond this, we will store your data for a period of one year after completion of the casting in order to check and, if necessary, defend against any third-party claims in connection with your casting.

Your data collected in accordance with section 2.b will be stored for the duration of the existing copyrights as proof of the rights of use under copyright law. A recording of the respective production, which may also contain your data, will be permanently archived for the purposes stated in section 2.c.

Your data collected in accordance with section 2.c will be processed for the duration of the broadcast, evaluation and marketing of the production.

Your data collected in accordance with section 2.d. will be stored for the duration of the statutory retention periods for a maximum of 10 years.

Your data collected in accordance with section 2.e will be stored in the casting database until you withdraw your consent. After your revocation, this data will be deleted from the casting database immediately.

6 What rights do I have in relation to my data?

You have the right to information about the personal data we have stored about you at any time. If your personal data is incorrect or no longer up to date, you have the right to request that it be corrected. Under certain circumstances, you may also have the right to request the erasure or restriction of the processing of your data in accordance with Article 17 or 18 GDPR.

If you have provided us with data and the processing by means of automated procedures is based on your consent or on a contract with you, you have the right to receive this data provided by you in a structured, commonly used and machine-readable format (right to data portability).

You can object to the processing of your data in accordance with Art. 21 GDPR.

In this case, we will no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or the processing serves the establishment, exercise or defense of legal claims.

If you wish to make use of your rights or if you have general questions about data protection in relation to castings and productions, you can contact the person named in section 1 at any time.

You also have the option of contacting a data protection authority and lodging a complaint there. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Kavalleriestr. 2-4, 40213 Düsseldorf. However, you can also contact the data protection authority responsible for your place of residence, which will then forward your request to the competent authority.
