Upon entering the studio, UFA SHOW & FACTUAL GmbH (“UFA”) shall be irrevocably authorized to make or have made video and audio recordings of the viewer on the occasion of the recording of the television program. UFA shall be granted the exclusive right free of charge, unlimited in terms of time and place, to use these recordings in whole or in part, directly or indirectly, as often as it wishes (1) on television and on the Internet, irrespective of the technical transmission method, the type of receiving device, the broadcasting station and the release date, (2) to make them available to users for individual or joint viewing from locations and at times of their choice by means of any terminal equipment (“on-demand”), (3) to distribute them on image/sound/data carriers of any kind for audiovisual exploitation (e.g. Blu-ray Disc), (4) to make them available on the Internet, irrespective of the technical transmission method, the type of receiver, the broadcaster and whether they are free of charge or free of charge to the consumer. (4) to perform publicly at trade fairs, public viewings and similar events, (5) to use for advertising and reporting on the show, (6) to archive, (7) to use for interactive forms of use and telecommunication services, (8) to use in the context of all technically as yet unknown types of use and (9) to store in databases for the above purposes. The rights granted may be transferred to third parties without the viewer’s consent to use the television program. The legitimate interests of the viewer shall be safeguarded. This clause does not affect cases of individual unreasonableness towards the viewer.
