All ticket purchases from UFA SHOW & FACTUAL GmbH (“UFA”) are subject exclusively to the following General Terms and Conditions (“GTC”). Insofar as other terms and conditions of the organizer or broadcaster apply in individual cases, UFA shall expressly point this out. If applicable, the terms and conditions of the organizer or broadcaster shall take precedence over these GTC.
2.1. The viewer is aware that the event will be recorded and subsequently exploited extensively. The following transfer of rights is therefore a mandatory prerequisite for attending the event.
2.2. By purchasing the ticket, or at the latest by using the ticket, the viewer irrevocably authorizes UFA to make and/or have made video and audio recordings of the viewer outside and inside the event on the occasion of the recording of the television program. Furthermore, the viewer grants UFA the exclusive, comprehensive and irrevocable right, unlimited in terms of time and place, to broadcast these recordings in whole or in part as often as desired (1) on television, the Internet and radio, irrespective of the technical transmission method (including live streaming), the type of receiving device, the broadcasting station and the remuneration or non-remuneration. (2) to make available to users for individual retrieval by means of any end device (e.g. television, computer, mobile end device) and any transmission channel (“on demand”), including on social media channels, (3) the right to reproduce or make available within a closed user group (so-called “closed circuit”, such as e.g. on social media channels). “closed circuit” such as e.g. in hospitals, airplanes, hotels, vehicles, schools); (4) to distribute for non-broadcast, audiovisual utilization on image/sound/data carriers, (5) to use for advertising and announcing the production in all media and printed matter of any kind, (6) to perform publicly for public relations purposes, at trade fairs, festivals and similar events, (7) to edit while respecting personal rights, (8) to archive, (9) to feed into databases, in particular the Internet, (10) to use for NFT or blockchain-based technologies, interactive forms of use and telecommunication services and (11) to use within the scope of all technically as yet unknown types of use. The rights granted may be transferred to third parties without the viewer’s consent for the use and exploitation of the television program. These third parties may in turn transfer the rights to others and grant them to others. The viewer’s legitimate interests shall remain protected. This clause shall not affect cases of individual unreasonableness towards the viewer.
2.3. If the viewer purchases tickets for third parties, he/she undertakes to obtain the rights from these third parties to the extent set out in section 2.2 and grants them to UFA at the time of purchase.
3.1. The ticket prices are made up of the admission price and a booking or system fee. The respective amount is shown on the website or in the booking letter.
3.2. As a rule, payments can be made by bank transfer (advance payment) to UFA and various other payment methods (e.g. Paypal) via external payment service providers. UFA is not liable for the services of the payment service providers. UFA is entitled at any time to restrict the choice of payment methods for individual sales, productions or as a whole.
3.3. If the ticket price is not paid within the period specified in the booking letter, UFA is entitled to cancel the booking.
4.1. If the viewer does not confirm the confirmation link sent as part of the booking letter within the period specified in the booking letter, UFA is entitled to cancel the booking.
4.2. In principle, the spectator has no right of withdrawal, revocation or cancellation. In particular, the spectator has no right of withdrawal for distance contracts for the sale of tickets for events (§ 312 g para. 2 sentence 1 no. 9 BGB).
4.3. If the spectator is unable to attend an event or can only attend with a smaller number of people, he/she shall inform UFA accordingly. Without such notification, UFA could suffer damages.
Tickets may not be resold. The ban also applies to sales on the so-called secondary ticket market, e.g. ticket exchanges and online marketplaces. These providers are not cooperation partners of UFA. UFA reserves the right to refuse admission on the basis of resold tickets. The same applies if tickets have not been sold but have been transferred to third parties who were not named as part of the ticket purchase.
6.1. Participation is generally possible from the age of 14. Detailed information on the minimum age can be found on the website.
6.2. Depending on the age of the underage spectators, the following restrictions apply and the following declarations must be submitted by the legal representatives of the underage person:
a. Underage spectators between the ages of 14 and 17 may only participate in the event if they have the written consent of their legal representatives to the underage person’s participation and the validity of the GTC. This also applies if the legal representatives accompany the minor.
b. Minors between the ages of 14 and 15 may only be admitted if accompanied by their legal guardian or another adult accompanying them. If the accompanying person is not the legal representative, a signed authorization from the legal representative must be presented.
c. Minors between the ages of 16 and 17 may only participate in the event without an accompanying adult if they have a signed declaration of consent from their legal representatives.
The relevant declarations to be signed can be found on the last page of this download. Admission will not be granted without submission of the declarations required according to age.
7.1. Tickets remain the property of UFA until the ticket price has been paid in full.
7.2. The spectator is obliged to check the tickets immediately upon receipt for correctness of the event data and completeness. If necessary, he/she must notify UFA of any inaccuracies. If the notification is not made up to two weeks before the event date, processing of the complaint cannot be guaranteed due to the deadline.
7.3. Tickets lose their validity when leaving the recording location.
8.1. UFA is entitled to deny the spectator access to the event if he/she does not comply with the relevant requirements for the event to which he/she was previously referred (e.g. minimum age). The same applies if the spectator violates these GTC (e.g. prohibition of resale) or circumvents these GTC (e.g. booking under different user profiles).
8.2. The instructions of the staff on site must be followed.
8.3. The spectator may not make and/or distribute any image and/or sound recordings during the event – including by cell phone etc.. In particular, it is prohibited to make these accessible to third parties via social media. Non-compliance may result in expulsion from the event site.
8.4. Bags, jackets, cell phones and recording devices of any kind may not be taken into the event room.
8.5. Smoking and the carrying of weapons and dangerous objects of any kind is prohibited in the event rooms.
8.6. At some events, stroboscopic and pulsating light effects are used. These can lead to epileptic seizures or impaired consciousness in some people. In addition, the noise level of the event can exceed 80 decibels.
8.7. Information for the current event can be found on the website, the booking letter or can be requested at ticketing@ufa.de.
8.8. Failure to comply with these regulations and/or the instructions of the staff may result in expulsion from the event site.
The viewer undertakes to maintain absolute secrecy about all information that comes to his/her knowledge in connection with the event, in particular about the content, course, persons involved, any prizes and his/her personal involvement before the television program is broadcast.
10.1. Visual obstructions must be expected. This does not entitle the ticket price to be reduced or waived. The same applies in the event of changes to the program or participating persons, insofar as this is reasonable for the spectator. (Free tickets will not be exchanged even if this is unreasonable).
10.2. UFA shall be liable without limitation for culpably caused damage resulting from injury to life, limb or health, in the event of gross negligence and intentional damage, fraudulent concealment of defects and the assumption of a guarantee.
10.3. In addition, UFA shall also be liable for simple negligence in the event of a breach of cardinal obligations. Cardinal obligations are essential obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the viewer regularly relies and may rely. In this case, UFA’s liability shall be limited to the damage typically foreseeable at the time the contract was concluded.
10.4. UFA shall have no further liability.
10.5. Insofar as liability is limited or excluded above, this shall also apply in favor of UFA’s vicarious agents.
11.1. If the event is canceled or postponed, UFA will refund the ticket price for tickets purchased from UFA. Fees for administrative services rendered (booking/system fees) will not be refunded. If the event is postponed, UFA shall be entitled to offer tickets for alternative dates instead of reimbursement, unless participation in the alternative date is demonstrably impossible or unreasonable for the spectator. The same applies if the originally booked seat is not available.
11.2. As a rule, the ticket price will be refunded within eight weeks of UFA becoming aware of the viewer’s request for a refund and the information required for the refund (e.g. account details). Any further claims are excluded.
11.3. Tickets that were not purchased directly from UFA will be refunded via the respective ticket agency.
If a party or a third party legitimately appointed by a party is prevented from fulfilling its contractual obligations as a result of force majeure or if fulfillment becomes economically or otherwise unreasonable as a result of force majeure, the contractual obligations of both parties shall initially be suspended for the duration of the force majeure. Force majeure is an external, unforeseeable event that neither party can avert or avert in good time despite exercising reasonable care, such as natural disasters, storms, fire, (civil) war, riots, terrorist acts, strikes, lockouts, power failures, epidemics, pandemics, official or judicial measures (regardless of their legality), statutory provisions. In such cases, the parties shall endeavor to adjust their contractual obligations to the changed circumstances in good faith. If these efforts fail and the force majeure lasts longer than 45 days, either party shall be entitled to terminate the contract extraordinarily with immediate effect or to withdraw from the contract without setting a further deadline (text form pursuant to Section 126b BGB shall suffice). Termination and withdrawal in accordance with this clause are also permitted prior to the expiry of the above period if it is highly probable that the conditions for termination will be met by the expiry of the period. Mutual claims for damages due to force majeure are excluded.
Information on data protection has been made available to the viewer. It is also available at https://www.ufa.de/datenschutzerklaerung/datenschutzhinweis-casting-und-ticketing. They are not part of the contract. The booking spectator is obliged to provide other accompanying persons who will also attend the production with the opportunity to take note of UFA’s data protection information.
Offsetting and retention rights of the viewer are excluded, unless the underlying claims are undisputed or have been legally established.
Should a provision be or become invalid, the remaining provisions shall nevertheless remain valid. The parties agree to replace the invalid provision with a valid provision that comes closest to the economic purpose of the parties. The same applies in the event of a gap in the contract.
