The protection and confidentiality of your data is of particular importance to UFA GmbH. The collection and use of your personal data takes place exclusively within the framework of the statutory provisions of the applicable data protection law. With this data protection declaration, we inform you which personal data we collect as part of your application process and for what purpose the data is used. UFA GmbH collects and uses your personal data exclusively in accordance with the provisions of the data protection laws of the Federal Republic of Germany and the European Union. In the following, we inform you about the type, scope and purpose of the collection and use of personal data.

Subject matter of data protection

The subject of data protection is personal data. According to Art. 4 No. 1 GDPR, this is any information relating to an identified or identifiable natural person (hereinafter “data subject”). This includes, for example, information such as name, postal address, email address or telephone number, but may also include usage data. Usage data is data that is required in order to use our website, such as information about the start, end and scope of use of our website and login data.

This privacy policy applies to the career portal and the applicant management system of UFA GmbH.

In accordance with Art. 13 GDPR, we explain below what information we collect during your online application process and how it is processed.

  1. Processing of personal data

Data entered by the user

To make the application process transparent for you, you can register. To do this, you must enter your name and e-mail address as well as a password. This data is required to set up and manage an account for you in the career portal. Last but not least, we also need this and any other data in order to be able to respond to requests, questions and criticism.

Further optional data are

  • Contact details (address, telephone number)
  • Curriculum vitae data (e.g. school education, vocational training, professional experience, language skills)
  • Profiles in social networks (e.g. XING, LinkedIn, Facebook)
  • Documents in connection with applications (application photos, cover letters, certificates, references, work samples, etc.)

  1. Use of the collected data

The data about the user is collected so that softgarden can provide the services. In addition, data is collected for the following purposes: Analytics, interaction with support and rating platforms, managing support and contact requests, managing user databases, managing contacts and sending messages, contacting the user, accessing third-party profiles (e.g. login via LinkedIn and XING), displaying content from external platforms.

Right of withdrawal

If we also receive and process personal data on the basis of a declaration of consent given by you, you have the right to revoke your consent for the future at any time without giving reasons (legal basis Art. 6 para. 1 sentence 1 a) GDPR, Art. 4 No. 11 GDPR). Order data processing and data security

Our online application portal is technically operated by our service provider softgarden e- Rrecruiting GmbH, Tauentzienstraße 14, 10789 Berlin, Germany (hereinafter: Softgarden). Softgarden only provides software and computing capacity and otherwise has no influence on the application process. This is order processing in accordance with Art. 28 GDPR.

Collection and use of your data

Automated data collection

softgarden and third-party services may collect files for operational and maintenance purposes that record the interaction taking place via this application (system logs) or use other personal data (e.g. IP address) for this purpose.

When you access softgarden products, your Internet browser automatically transmits data for technical reasons. The following data is stored separately from other data that you may transmit:

  • Date and time of access,
  • Browser type and version,
  • operating system used,
  • URL of the previously visited website,
  • Amount of data sent,
  • IP address of the access

This data is stored exclusively for technical reasons and is not assigned to a specific person at any time. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR.

Processing of CV documents

softgarden processes and analyzes documents uploaded by the applicant to extract CV data. Processing takes place within the softgarden infrastructure. Data is not transferred to third parties. The legal basis is § 26 para.1 BDSG-“new”.

Forwarding of data

As part of the further development of our business, the structure of softgarden e-recruiting GmbH may change by changing its legal form or by founding, buying or selling subsidiaries, parts of the company or components. In such transactions, customer information is passed on together with the part of the company to be transferred. Whenever personal data is passed on to third parties in this context, softgarden ensures that this is done in accordance with this privacy policy and the relevant data protection laws. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR.

Feedback module

In order to optimize our application processes, softgarden will give you the opportunity to provide feedback at various stages of the application process. The position title and location of the position as well as the job category and, if applicable, the type of employment for which you have applied will be recorded. This information, together with your feedback, may also be transmitted to external partners such as kununu. Personal data other than the position title and location of the position, job category and type of employment are not collected. Personal data is not transmitted. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR.

Subscription to new job offers

On the Career Board, you have the option of being automatically informed about new vacancies at UFA GmbH. This is done either by means of an e-mail newsletter or via an RSS feed. The target group, job group and location can be entered to specify the subscription. However, you can also be informed about new vacancies without further specification. If you want to be informed about new job vacancies via the e-mail newsletter, we need your e-mail address. The legal basis for this is your consent to receive the newsletter in accordance with Art. 6 para. 1 lit. a GDPR. You can revoke your consent to receive the newsletter at any time via the unsubscribe link in the newsletter. No personal data is processed via the RSS feed to inform you about new job advertisements.

Talent pool

If your application is unsuccessful, you may be added to our talent pool. If a similar or otherwise suitable position is open, we can then contact you about it. Inclusion in the talent pool is on a voluntary basis through the use of an opt-in link. The legal basis for this is the consent of the data subject to inclusion in the talent pool within the meaning of Art. 6 para. 1 lit. a) GDPR. You can revoke this consent to inclusion in the pool at any time.

Cookies

softgarden stores so-called “cookies” in order to offer you a comprehensive range of functions and to make the use of our websites more convenient. “Cookies are small files that are stored on your computer with the help of your Internet browser. If you do not wish cookies to be used, you can prevent them from being stored on your computer by making the appropriate settings in your Internet browser. Please note that this may limit the functionality and range of functions of our website.

Transient cookies

Transient cookies are automatically deleted when you close the browser. These include session cookies in particular. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to our website. This type of service allows users to interact with online survey platforms operated by third parties directly from this Application. If a corresponding service is installed, it may be able to collect navigation and usage data on the pages on which it is installed even if users do not actively use the service. The SurveyMonkey Widget is a service for interacting with the SurveyMonkey platform for online surveys from SurveyMonkey Inc.

Legal measures

The user’s personal data may be used by the responsible body for legal purposes in court proceedings or before possible lawsuits arising from the improper use of softgarden products or the associated services. The user is aware that softgarden may be requested by the authorities to disclose personal data. The legal basis is Art. 6 para. 1 sentence 1 lit. e GDPR.

Further information on the collection or processing of personal data can be requested at any time from the controller using the contact details provided.

Rights of users

Users are entitled to know at any time whether their personal data has been stored and may contact the data controller to find out the content and origin of the stored data, verify its accuracy, request its integration, deletion, updating, rectification or transformation into an anonymized format or the blocking of data stored in violation of the law, as well as oppose its processing for legitimate reasons.

You can also exercise your right to object at any time without giving reasons and amend or completely revoke the declaration of consent you have given with effect for the future. You can send your revocation to the contractual partner either by post, e-mail or fax. You will not incur any costs other than the postage costs or the transmission costs according to the existing basic rates. Please note, however, that further use of the software is then not possible.

Storage duration

After completion of the application process, your data will be stored for 6 months in the event of a rejection.

softgarden products support do not track requests through web browsers.

Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR. The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Art. 78 GDPR.

Changes to this privacy policy

softgarden reserves the right to make changes to this privacy policy at any time by informing its users accordingly on this page. Users are therefore advised to visit this page regularly and to check the date of the last change indicated at the bottom of the page. If a user rejects a change to the privacy policy, they may no longer use the services of softgarden and may request softgarden to delete their personal data. Unless otherwise stated, the current privacy policy applies to all personal data that the controller has stored about a user.
